“Whilst the Partnership has a net deficit on its balance sheet, the financial statements have been prepared on a going concern basis as the Developer has provided sufficient cash security and income guarantees to support its obligations to the Partnership, which the Partnership uses in turn to provide security for its bank obligations. The arrangements which provide both had been subject to a fixed term expiring in April 2026. During the year these arrangements were extended on an evergreen basis (subject to termination on notice).”

• “The LLP is party to ongoing tax litigation jointly with Cobalt Data Centre 3 LLP in respect of capital allowances claimed in 2010/11. HMRC has been awarded costs of £77,500 in respect of the Supreme Court proceedings, of which the LLP's share of costs is £46,500. There is therefore currently a joint contingent liability with Cobalt Data Centre 3 LLP in respect of them.”
