- “In June 2023, a High Court judgment in the case of Virgin Media vs NTL Pension Trustees II Limited provided a ruling that has the potential to lead to additional pension obligations in certain circumstances. The issue relates to the requirement arising from the Section 37 of the Pension Scheme Act 1993 for written actuarial confirmation from the Scheme Actuary that the scheme would continue to meet the 'reference scheme test' in certain circumstances where the scheme rules were changed for an occupational DB scheme contracted out on a reference scheme test basis between 6 April 1997 and 5 April 2016 (inclusive). The High Court ruling determined that both retrospective and prospective changes made without a section 37 actuarial confirmation are void. An appeal hearing took place in late June 2024; although narrow in scope, the appeal upheld the original High Court judgment.”
